requisition for extradition has been made.

After discussing the matter with

the Attorney-General I wrote the minute of which copy is

enclosed in which I set out various alternative arrange-

-ments that might be made to meet the difficulty created

by Sir F. Piggott s pronouncement; and I enclose copy of

the Attorney-General's minute in reply.

The situation has been altered

since I wrote my Despatch under reference and in view of

the Chief Justice's clear and categorical pronouncement,

it would not, as Mr. Rees-Davies points out, be proper to

amend the Chinese Extradition Ordinance in the direction

suggested in that Despatch except on Your Lordship's

express instructions. Pailing such instructions I have

therefore to suggest that the course indicated in (d) of

my minute of 3rd. October, 1910, be adopted.
